ProSlide Technology Inc., an industry leader in water ride manufacturing and design, is celebrating a landmark legal victory that continues to protect its unique RallyPOINT water slide designs.
The court ruling, rendered by Ankara 1st Civil Court for Intellectual and Industrial Rights, ruled that ProSlide’s RallyPOINT design possessed sufficient ‘individual character’ compared to others on the market. The case took place at an IP Court in Turkey, providing a significant jurisdiction for intellectual property law.
ProSlide is a global leader in the design and manufacture of water rides, providing high-performance attractions to water parks around the world. The award-winning firm ProSlide has won 19 World Waterpark Association Leading Edge Awards in the last decade, and 16 “Best New Water Ride” IAAPA awards in the last two decades.
Protecting innovation
The latest determination allows ProSlide’s innovative slide design to benefit from intellectual property protections accommodated by the Industrial Property Code.
The court’s ruling and reasoning in this case was recently published on the legal review website MARQUES. Its article, The Role of Informed User and Freedom of Choice in the Assessment of Individual Character of a Design, is written by the Turkish IP law firm representing ProSlide in the case, Gün & Partners. The author notes that the decision made by the court “will pave the way for providing a broader protection to designs”.
